伴隨著現代社會的進步,消費者對於產品的要求也漸趨多樣,不再僅侷限於產品的價格、功能與品質,產品外觀設計亦可能為消費者選購產品的關鍵因素之一。為了增加產品之競爭力,取得消費者的喜愛並吸引消費者注意,業者無不針對產品之外觀形狀或包裝為創新,努力創造出特殊且具視覺效果之產品外觀以抓住消費者目光,進而促進其購買欲望。產品外觀設計為人類知識文化之產物,係為廠商及設計者的智慧與心血結晶,如何賦予產品外觀設計完善的智慧財產權利保護,以維護產品及產業的競爭優勢,是為一重要議題。 業者可能以其產品外觀設計之特殊設計作為其商品表徵,使消費者得由其產品或包裝外觀,辨別其製造來源,該設計可能取得商標權。產品外觀設計亦可能以其外觀特殊之形狀、花紋、色彩或其結合來呈現視覺效果,成為設計專利保護之客體。產品外觀設計既為業者之設計創作結果之展現,其設計可能屬於人類文化上之精神創作,因而得受著作權法之保護。是故,產品外觀設計可能同時具備商標法、著作權法及專利法上之要件而同時取得三種智慧財產權利。因此,本論文將著重於探討產品外觀設計是否能獲得兩種或以上之智慧財產權利保障,其在兩種或以上之智慧財產權利保護時,不同智慧財產權法規定同時適用下各種權利應如何競合,不同之權利保護期間是否會互相影響,就此類爭議應如何進行調和解決等議題為探討。 With the progress of modern society, product design may also be one of the key factors for consumers to buy products. In order to increase the competitiveness of the product and to attract the attention of consumers, the industry strives to create special and visual effects for the product design. Product design is the combination of human knowledge and creativity. Therefore, to give the product design perfect intellectual property rights and to maintain the competitive advantage of the product and the industry has become an important issue.Product design may involve several intellectual property laws, such as trademark law, patent law and copyright law. It may meet the requirements of trademark law, patent law and copyright law at the same time. Therefore, a product design may obtain three kinds of intellectual property rights simultaneously. This thesis will focus on the question that whether the product design can obtain two or more intellectual property rights protection at the same time. Furthermore, this thesis will also discuss when a product design obtain two kinds of intellectual property rights, how to deal with the disputes of different rights protection period.
