消費社會已然到來,而消費爭議無所不在,商品與服務責任更形重要,惟其核心概念,可合理期待之安全性,乃一不確定法律概念,導致責任成立與否時常發生爭議,無形中增加了紛爭解決的成本。此外,消費者保護法之制定不僅是為了合理保護消費者權益,也為促進企業良性發展,因此如何平衡兩者,成為一項重大課題。本文第一章首先闡述研究目的及動機。第二章則介紹消費者保護法無過失責任之構成要件,並針對核心要件─「可合理期待之安全性」加以探討。透過閱覽相關實務判決,歸納出可合理期待安全性之判斷標準,並說明企業經營者因食品欠缺安全性所應負之法律責任,以及實務上將可合理期待安全性與過失相混淆的情形。第三章說明無過失責任之理論基礎並介紹外國與我國關於無過失責任之減免責任事由。第四章彙整前述各章之內容提出本文觀點,以期令消費者保護更加周全,使企業經營者責任適度緩和。 It is the age of Consumer society; therefore, the disputes of consumers arise frequently. The liability of products and service has become more significant. Consumer society has arrived, and consumer disputes are everywhere so products and service liability become more important. However, the reasonable expectation of safety which is the main concept of products and service liability is an uncertain legal concept, leading to the establishment of the liability is often controversial. Accordingly, the cost of resolution to the dispute has been increased imperceptibly. In addition, the legislative purpose of consumer protection law is not only protecting consumer rights in a rational way, but also promoting constructive development of traders. As a result, it would be a consequential matter to make a balance between consumer and trader.The Chapter One is the elaboration of purpose and motivation. The Chapter Two introduces the elements of the strict liability of consumer protection law and explores the main elements - "the reasonable expectation of safety ". By reviewing relevant judgments, this study concludes the criteria for judging of the reasonable expectation of safety. Besides, this study describes the legal liability of traders due to the lack of food safety. Furthermore, the study explains the misunderstanding that courts had between reasonable expectation of safety and fault. The Chapter Three explains the theoretical basis of strict liability and introduces the reasons for liability reduction and exemption of strict liability among foreign countries and Taiwan. The Chapter Four summarizes the contents of the previous chapters. The study expects to present the views of making consumer protection more comprehensive and moderating the liability of the traders properly.
