摘要:	在民主主義國家中，政府的權力均來自於法律的授權，而該權力除了是維繫一個國家的治權外，另一個意義是施以人民生活上之保障。就勞動者保護而言，以資本主義思想為立法之國家，除了背負經濟發展促進人民生活條件提升外，對於勞動者勞動力的產出過程中所面臨之不利益，亦尚需特別保護，而此種保護目的，不僅在維繫治權，更避免資本家對於勞工之剝削，此乃勞動檢查由國家介入與干預私法契約之意義。近兩年來，勞動部以透過計劃之方式，除將其勞動條件檢查權授予各地方政府外，更以年度計劃聘用325 位勞動條件檢查員行使該勞動條件檢查，使其各地方政府有足夠之經費及人力對其轄內之事業主實施勞動條件之檢查。本研究以為，勞動條件檢查員之進用，仍應透過國家考試之方式選用人才，除可使人員獲得身分上之保障外，更可對於勞動條件檢查業務之推行，能有永續性之發展，並透過此保障，達成文官依法執行公權力之體現；對於現行之聘用檢查人力，仍應增加其專業度之在職訓練時數，並由勞動部制定統一之考核制度，以及定期舉行檢定考試，以達現行人力專業度之提升及不適任人力之汰除，並作為勞動條件檢查員文官制度落實前之人力因應。 In democracy country, government’s authority comes from law, and the authoritynot only maintain a country, but also protect people. For laborer protection, as a capitalistic country, is not only to promote economic development and living condition,but also to protect the disadvantage during the process. This protection not only maintain country, but also avoid exploitation from capitalist. This is the value for government to intervene labor inspection and contract.In recent two years, Ministry of Labor empower the authority of labor inspection to local government, and employ 325 inspectors to execute labor inspection, and to make sure every local government have enough budget and manpower to execute inspection in their own area.In this research, we think that labor inspector should be employed by nationalexamination, not only to protect the sense of identity, but also have sustainable development of inspection affairs. Under this protection, this is also to achieve civil servant execute inspection under public power. For current employed inspectors,the government should increase on-the-job training, besides that the Ministry of Labor should develop an examination system, and to hold regular examination, in order to promote the specialization of inspector and to eliminate the unqualified manpower, as toadapt to current situation before develop civil servant system.
